By downloading, accessing, or using the OGV Options Analyzer mobile application ("App") or website at ogvtrading.com ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Website.
OGV Options Analyzer is owned and operated by OGV Trading LLC, a Nevada limited liability company ("OGV," "we," "us," or "our").
THE APP IS NOT FINANCIAL ADVICE. OGV Options Analyzer is an educational and analytical tool designed to help users evaluate options contracts. The scores, signals, recommendations, and analysis provided by the App are for informational and educational purposes only.
You are solely responsible for your own investment decisions. Always consult with a qualified financial advisor before making investment decisions.
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
To access certain features of the App, you must create an account. You agree to:
Accounts are limited to one per person and are non-transferable.
We reserve the right to suspend or terminate your account at any time for any reason.
The Learn section of the App is available without a subscription.
Access to the Calculator, Scanner, Saved Setups, Volatility Spread, and other premium features requires an active Pro subscription.
Prices are in US dollars and may be updated with notice to subscribers.
New subscribers may be eligible for a 7-day free trial. A valid payment method is required to start the trial. If you do not cancel before the trial ends, you will be charged the applicable subscription fee.
All payments are processed through the Apple App Store or Google Play Store. Billing is governed by the terms of your app store account. If a payment fails, access to Pro features will be suspended until payment is resolved.
You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
We reserve the right to change subscription prices. Existing subscribers will be notified at least 30 days before any price increase takes effect.
You agree not to:
The App, including its scoring algorithms, analysis methods, user interface, design, code, content, and all related intellectual property, is owned by OGV Trading LLC and protected by copyright, trade secret, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms.
If you provide feedback, suggestions, or ideas about the App, you grant us the right to use that feedback without compensation or obligation to you.
The App displays market data sourced from third-party providers. We do not guarantee the accuracy, completeness, or timeliness of this data. Market data may be delayed and should not be relied upon for time-sensitive trading decisions. Real-time data availability depends on our third-party data providers. Market data is provided as-is from third-party sources. OGV does not independently verify the accuracy of market data.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OGV TRADING LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Without limiting the foregoing, OGV Trading LLC shall not be liable for any trading or investment losses whatsoever, regardless of whether the user relied on data, scores, or analysis provided by the App.
You agree to indemnify, defend, and hold harmless OGV Trading LLC and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in the State of Nevada.
Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If unresolved within 30 days, either party may pursue resolution in the courts located in the State of Nevada.
OGV Trading LLC shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to server outages, market data provider disruptions, natural disasters, or internet service interruptions.
By creating an account, you consent to receive electronic communications from us regarding your account, the App, and updates to these Terms. These communications may include service announcements, security alerts, and billing notices.
These Terms, together with the Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and OGV Trading LLC regarding the App.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or sending you a notification. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
